Terms of Service
These terms govern your use of our website. Client work is governed by a separate signed agreement — this page covers the site itself.
Agreement to terms
By accessing or using midasautomate.com (the "Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site.
These terms apply to everyone who visits the Site, including visitors who submit enquiries. If you are agreeing on behalf of a company, you confirm you have authority to do so.
What we do
Midas Automate provides AI, automation, software engineering, data, cloud, security, and digital growth services to businesses. The Site describes those services and lets you contact us about them.
Information on the Site — including case studies, metrics, and estimated timelines — is provided for general information. Results described relate to specific client engagements and are not a promise of similar outcomes for your business.
Client engagements
Nothing on this Site is an offer or a contract for services. Submitting a form, requesting a quote, or having a conversation with us does not create a client relationship.
All work we perform is governed by a separate written agreement — a proposal, statement of work, master services agreement, or similar — signed by both parties. That agreement sets out scope, fees, timelines, ownership, confidentiality, and warranties.
If anything in these Terms conflicts with a signed client agreement, the signed agreement takes precedence for that engagement.
Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorised access to the Site, its servers, or connected systems
- Introduce malware, or interfere with the Site's normal operation
- Scrape, harvest, or systematically extract content or contact details from the Site
- Submit false information, impersonate another person, or use our forms to send spam
- Copy, reproduce, or republish substantial portions of the Site without our written permission
We may restrict or block access to the Site at our discretion if we believe these terms have been breached.
Intellectual property
The Site and its contents — including text, design, graphics, code, and the Midas Automate name and logo — are owned by us or our licensors and protected by intellectual property laws.
You may view and print pages for your own internal reference. Any other use, including reproduction, modification, distribution, or commercial exploitation, requires our prior written consent.
Client names, logos, and product images shown in case studies remain the property of their respective owners and are used with permission or as permitted by law.
Content you submit
When you send us information through a form or by email, you confirm that you have the right to share it and that it is accurate to the best of your knowledge.
We treat enquiry details as confidential and use them only to respond to you, as described in our Privacy Policy. Please do not send us sensitive personal data, credentials, or confidential third-party information through the website forms.
Third-party links and services
The Site may link to third-party websites or reference third-party tools and platforms. We do not control those services and are not responsible for their content, availability, terms, or privacy practices. Any dealings with them are between you and that third party.
Disclaimers
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any information on it is complete, current, or accurate at all times.
Nothing on the Site constitutes legal, financial, tax, or professional advice. You should obtain your own advice before making decisions based on information published here.
Limitation of liability
To the fullest extent permitted by law, Midas Automate and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of the Site.
Our total liability arising from or related to the Site will not exceed one hundred US dollars (US$100). Liability arising from client work is addressed in the applicable signed agreement, not here.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless Midas Automate from any claims, damages, losses, and reasonable legal fees arising out of your misuse of the Site, your breach of these Terms, or your violation of any law or third-party right.
Privacy
Your use of the Site is also governed by our Privacy Policy, which explains what we collect and how we use it. Please read it alongside these Terms.
Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction.
Changes to these terms
We may update these Terms from time to time. The "last updated" date at the top reflects the most recent version. Continued use of the Site after changes are posted means you accept the revised Terms.
If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect.
